These Terms are a binding contract between your business and Voitas Ventures s.r.o., governed by Czech law.
Key terms you accept by agreeing. We list them here because they matter most. By clicking to accept, you expressly accept each of them (Section 1753 of the Czech Civil Code):

- The Service, Site hosting and AI Output are provided “as is”, with no uptime commitment (Sections 6, 8 and 14).

- Claims against us must be brought within one year (Section 15.6).
- Plans renew automatically. Fees and Credits are non-refundable (Section 9).
- We may suspend the Service or a Site for breaches, risks or non-payment (Section 10).

Who we are
Tandmade is operated by Voitas Ventures s.r.o., ID No. 14389100, VAT No. CZ14389100, registered office Jabloňová 2881/98, Záběhlice, 106 00 Prague 10, Czech Republic, registered in the Commercial Register maintained by the Municipal Court in Prague, Section C, File 364980 (“Tandmade”, “we”, “us”). Who may use the Service
2.1 Business use only. The Service is a professional tool for designers, freelancers, agencies and businesses. You may use it only in the course of your business or profession within the meaning of Section 420 of the Civil Code. By accepting these Terms you confirm that you do. We do not offer the Service to consumers.
2.2 Accepting for an organisation. If you accept on behalf of a company or other organisation, you confirm you have authority to bind it. “You” then means that organisation.
2.3 Age and sanctions. You must be at least 18. You may not use the Service if you, or anyone who owns or controls you, is subject to EU, UN, UK or US sanctions, or if you are in a territory under comprehensive sanctions.
2.4 Mandatory law. If a court treats you as a consumer despite Section 2.1, the mandatory consumer protections of your country apply. The rest of these Terms stays in force.
The agreement and definitions
3.1 What makes up the agreement. The agreement between you and us (the “Agreement”) consists of these Terms, the Acceptable Use Policy (“AUP”), the Data Processing Addendum (“DPA”) and any plan or order you buy. If they conflict, a signed order prevails, then the DPA for personal data, then these Terms, then the AUP. Our Privacy Policy explains how we handle personal data as a controller. It is information, not part of the Agreement.
3.2 Definitions.
- “Service” — the Tandmade platform: the editor, dashboard, hosting of Sites, AI Features, APIs, the MCP server and related support, at tandmade.com, app.tandmade.com and related domains.
- “Workspace” — the space where your Sites, projects, members and billing live.
- “Authorized User” — anyone you let into your Workspace or a Site, including team members, guests, content editors and your Clients’ people.
- “Site” — a website you create, import or manage in the Service, including its code, design system, pages and content.
- “Client” — a third party for whom you build or run a Site.
- “Customer Content” — everything you, your Authorized Users or your Sites submit, upload, import or collect: text, images, code, designs, collection entries, form submissions, comments and prompts. It includes Visitor Data and Output.
- “Visitor” — a person who visits a Site or submits one of its forms. “Visitor Data” — personal data about Visitors processed through a Site.
- “AI Features” — features that use machine-learning models: the agent, the builder (Figma and URL import), AI writing and similar. “Output” — what AI Features generate for you.
- “Connected Agent” — a third-party AI agent or app you authorise to act in your Workspace, for example through MCP.
- “Plan” — a paid subscription that activates one Site. “Credits” — units that AI Features consume.
- “Usage Data” — data about how the Service is used and performs (logs, metrics, telemetry), not including the substance of Customer Content.
Accounts and Workspaces
4.1 Your account. Give us accurate information and keep it current. You sign in with a magic link or a third-party identity provider, so keep your email account and devices secure: whoever controls your inbox can sign in as you. One account is for one person; don’t share it.
4.2 Responsibility for your Workspace. You are responsible for everything that happens in your Workspace, and for the acts of your Authorized Users and Connected Agents as if they were your own. Tell us at once at hey@tandmade.com if you suspect unauthorised access.
4.3 Owners and admins. We may rely on instructions from a Workspace owner or admin, including to invite or remove people, transfer or delete Sites and cancel Plans. Disputes between members of a Workspace are theirs to resolve.
Agencies, Clients and handover
5.1 Building for Clients. You may use the Service to build and run Sites for your Clients. You are responsible to us for your Clients’ use of your Workspace. You confirm that each Client has authorised you to put its content, data, brand and domains into the Service. Your contract with your Client is between the two of you; we are not a party to it and have no obligations under it.
5.2 Handover. When a Client accepts a transfer, the Site, its content, form submissions and domain connection move to the Client’s Workspace. From then on the Client is our customer for that Site, chooses and pays its Plan, and decides who keeps access. You keep access only as a guest, for as long as the Client allows.
5.3 Ownership disputes. We do not decide who owns a Site, a domain or content between you and a Client. We act on our records of which Workspace owns a Site, on a final court decision, or on a joint written instruction from both of you. We are not liable for acting on our records.
The Service
6.1 Changes to the Service. We develop the Service continuously and may add, change or remove features. If we remove a material paid feature during a paid period, we give you reasonable notice or a pro-rata credit.
6.2 No uptime commitment. We aim to keep the Service and your Sites available, but we commit to no uptime, response time or support level unless we sign a separate service-level agreement with you. The Service depends on third-party infrastructure and may be interrupted for maintenance, incidents or reasons outside our control.
6.3 Free use and previews. Workspaces, drafts, review links and starter Credits are free. Review links are previews: hidden from search engines and labelled “Built with Tandmade”. We may limit, change or end free use at any time. We may delete a Site that has no Plan and has not been edited for 12 months, after 30 days’ notice to the Workspace owner.
6.4 Beta features. Features marked beta, preview, labs or similar are provided as they are, may change or stop without notice, and are excluded from any commitment we make.
6.5 Backups and export. We keep backups to protect the Service, not as a backup service for you. You can export a copy of each Site at any time. Keep your own copies of anything you can’t afford to lose.
Your content and your Sites
7.1 You own your content. As between us, you and your licensors own Customer Content. We claim no ownership of it.
7.2 Licence to us. You grant us a non-exclusive, worldwide, royalty-free licence, for the term of the Agreement and any retention period under it, to host, store, copy, process, transmit, display, adapt (for example resize, compress, convert or reformat) and back up Customer Content, and to use it to provide, secure, support and fix the Service. We may sublicense these rights to our sub-processors and subcontractors only as far as these purposes need. We do not use Customer Content to train generalised AI models.
7.3 Your responsibility for content. You alone are responsible for Customer Content and your Sites, including that:
- you hold all rights and licences needed for it, including for images, fonts, video, code, trademarks and imported material;
- it and your Sites comply with the AUP and with every law that applies to you, your Clients and your Visitors — including privacy notices, cookie consent, the business identification required by Section 435 of the Civil Code, consumer protection, accessibility, advertising rules and any required labelling of AI-generated content;
- you have a lawful basis for, and give the required notices about, any Visitor Data.
7.4 Visitor Data. For Visitor Data and other personal data in Customer Content, you are the controller (or a processor for your Client) and we are your processor. The DPA applies.
7.5 Domains and addresses. You are responsible for registering, renewing and configuring your own domains and DNS. Default addresses on tandmade.link and preview addresses belong to us. We may change or reclaim them, and you acquire no rights in them.
7.6 Monitoring and removal. We do not generally monitor Customer Content and have no obligation to. We may review, restrict, remove or disable access to Customer Content or a Site if we reasonably believe it breaches the Agreement or the law, or if a court or authority requires it. Section 11 describes how we tell you.
7.7 Showcase. We may name you as a customer and link to your live Sites in our marketing. Email us to opt out and we stop within 30 days.
AI Features, imports and Connected Agents
8.1 How AI Features work. AI Features send your prompts and the relevant Customer Content (text, code, screenshots, designs) to third-party model providers, currently Anthropic, to generate Output. Our providers process it under commercial terms that do not allow them to train their models on it.
8.2 Output is yours, and your responsibility. As between us, you own Output to the extent it is protected at all, and we assign to you any rights we have in it. Output may be inaccurate, incomplete or insecure, may resemble Output generated for others, and may infringe third-party rights. Review Output before you publish or rely on it. You are responsible for Output you publish.
8.3 Logs of AI work. We log AI interactions (prompts, Output, tool calls, timings) to run, debug, secure and measure the quality of AI Features. We keep them as the Privacy Policy and DPA describe.
8.4 Imports. You may import a design (for example from Figma) or an existing website only if you own it or its owner has authorised you to copy it. Importing someone else’s site without permission breaches the AUP. The same applies to any website we migrate for you.
8.5 Connected Agents. A Connected Agent you authorise acts on your behalf, with your permissions; its actions are your actions. We are not responsible for third-party agents or their providers. You can revoke access at any time in your account.
8.6 Changes and limits. We may change model providers, models and the number of Credits a task costs. AI Features may refuse, stop or fail, and we may apply rate limits.
Fees, Plans and Credits
9.1 Plans. A Plan activates one Site and is billed in advance, monthly or yearly. Plans renew automatically for the same period until cancelled. Current prices are on our pricing page and at checkout.
9.2 Credits. AI Features consume Credits. Each active Plan adds monthly Credits to the Workspace; they expire at the end of the calendar month after the month in which they were added. Purchased top-ups expire 12 months after purchase. Starter Credits are a free trial and may change or expire. Credits have no cash value, are not electronic money, and cannot be transferred, exchanged or refunded. They lapse when the Workspace is deleted. We may correct Credits granted in error.
9.3 Payment. Stripe processes payments. You authorise us and Stripe to charge your payment method for each Plan period, each top-up and any automatic top-up you turn on, until you cancel or turn it off. You agree to receive invoices electronically.
9.4 Taxes. Prices are in US dollars and exclude VAT and other taxes. We add VAT where the law requires; where the reverse charge applies, you account for the tax. Give us accurate billing details and a valid VAT ID. You bear taxes and penalties that result from inaccurate details.
9.5 Price changes. We may change prices. A new price applies from your next renewal, and we tell you at least 30 days in advance. If you don’t agree, cancel before the renewal.
9.6 Cancellation. You may cancel a Plan at any time; it ends at the end of the paid period. Deleting a Site cancels its Plan at the end of the period. Deleting a Workspace or your account cancels all its Plans immediately.
9.7 No refunds. Fees are non-refundable, including for partial periods, unused Credits, Sites you stop using and cancellations, unless these Terms say otherwise or the law requires a refund.
9.8 Migration. A yearly Plan includes one migration of an existing website. We aim to deliver a review link within 48 hours of receiving everything we need, and connect the domain once you approve. This is a target, not a guaranteed deadline. A migration has no cash value and lapses with the Plan.
9.9 Late payment. If a payment fails, we may retry it and pause publishing and AI Features; after 14 days’ notice we may suspend your Sites. Overdue amounts bear statutory late-payment interest under Section 1970 of the Civil Code. We may also claim the statutory compensation for recovery costs and reasonable collection costs.
9.10 Billing disputes. Tell us about a disputed charge within 60 days, or it becomes final. Raise disputes with us before your bank: a chargeback without contacting us first breaches the Agreement. You may not set off any claim against amounts you owe us.
Suspension
10.1 We may suspend your access, your Workspace, AI Features or a Site, in whole or in part, if:
- you or your Site breach the AUP, or we reasonably suspect illegal content or activity;
- your use poses a security risk or could harm the Service, other customers, Visitors or us;
- payment is overdue (Section 9.9);
- a law, court or authority requires it; or
- we reasonably suspect fraud or abuse of free use or Credits.
10.2 We give notice before suspending where practical, otherwise promptly after. We limit a suspension to what is reasonably needed and lift it once the cause is resolved. Fees remain payable during a suspension you caused.
Content notices (Digital Services Act)
11.1 Reporting. Anyone can report content on a Site they consider illegal through hey@tandmade.com, as the AUP describes. Authorities contact us at the same address. We are the single point of contact under Articles 11 and 12 of the Digital Services Act; we communicate in English and Czech.
11.2 Our decisions. We decide on notices diligently and objectively, with human review. If we restrict content or a Site, we send the affected customer a statement of reasons, including the facts relied on and how to contest the decision. You may reply and we will review our decision. You may also go to court.
Our intellectual property
12.1 Ownership. We and our licensors own the Service, its software, the editor, design systems, templates, documentation and our trademarks. We grant you a limited, non-exclusive, non-transferable right, without the right to sublicense, to use the Service during the term of the Agreement for your business and to build and run Sites for your Clients.
12.2 Your exported Sites. The code we generate into your Sites, and any Tandmade runtime code included in an export, is licensed to you perpetually, worldwide and royalty-free, to run, modify and host those Sites anywhere, including after the Agreement ends. This licence does not let you build or offer a website-building product or service with that code.
12.3 Restrictions. You may not: copy, modify or create derivative works of the Service other than your Sites; reverse engineer it, except where the law expressly allows; resell or provide the Service to third parties beyond what Section 5 allows; circumvent Credit, usage or security limits; access it by automated means other than our APIs and MCP server; or use it to build a competing product.
12.4 Feedback and Usage Data. We may use your suggestions and feedback freely, without obligation to you. We own Usage Data and may use it to operate, secure and improve the Service. We publish it only in aggregated form that identifies neither you nor any person.
Confidentiality
Each party keeps the other’s non-public information received under the Agreement confidential and uses it only to perform the Agreement. This does not apply to information that is public through no fault of the recipient, already known to it, independently developed, or that the law requires it to disclose. Sections 7 and 8, the DPA and the Privacy Policy govern how we handle Customer Content.
Warranties and disclaimers
14.1 Mutual. Each party confirms it has authority to enter into the Agreement.
14.2 Disclaimer. Except as the Agreement expressly states, the Service, AI Features, Output, Site hosting and support are provided “as is” and “as available”. We give no warranties or assurances, express or implied, of merchantability, fitness for a particular purpose, availability, accuracy, security, non-infringement or freedom from errors. To the extent the law permits, the statutory provisions on defective performance (Sections 1914 to 1925 of the Civil Code) do not apply.
14.3 Your results. We are not responsible for the commercial results of your Sites, search rankings, conversions, delivery of form emails, or whether your Sites meet the legal requirements that apply to you or your Clients.
Limitation of liability
15.1 Excluded loss. Neither party is liable for lost profit, lost revenue, lost business opportunities, loss of goodwill, indirect or consequential loss, or the cost of substitute services. For loss or corruption of data you could have avoided by exporting it, our only obligation is reasonable efforts to restore it from our latest available backup. We do not undertake to compensate non-pecuniary harm (Section 2894(2) of the Civil Code).
15.2 Cap. Our total liability arising out of or in connection with the Agreement, for all claims together, is limited to the higher of (a) the fees you paid us for the Service in the 12 months before the event giving rise to the claim, and (b) USD 100.
15.3 Third parties. We are not liable for third-party services, networks, model providers or Connected Agents, or for anything your Clients, Visitors or Authorized Users do.
15.4 What is not limited. Sections 15.1 to 15.3 do not limit liability that the law does not allow to be limited, in particular under Section 2898 of the Civil Code for harm caused intentionally or by gross negligence, or harm to a person’s natural rights. They also do not limit your payment obligations or Section 16.
15.5 Force majeure. Neither party is liable for failures caused by circumstances beyond its reasonable control, including failures of cloud, network, payment or AI providers, cyberattacks, power outages, strikes, epidemics, war and acts of authorities (see also Section 2913(2) of the Civil Code). This does not excuse payment obligations.
15.6 Time limit for claims. Under Section 630 of the Civil Code, the limitation period for any claim against us arising from the Agreement is one year from the day the claim could first be exercised.
Your obligation to compensate us
16.1 You will compensate us, our affiliates and our staff for all losses, fines, damages, settlements and reasonable costs (including legal fees) arising from any claim by a third party or an authority that relates to: Customer Content and your Sites; your processing of Visitor Data as controller; your Clients’ claims against us; imports you made or requested; your breach of the Agreement or the AUP; or your breach of law.
16.2 We will tell you promptly of such a claim, let you control its defence if you confirm in writing that you will compensate us, and cooperate reasonably at your cost. You may not settle a claim in a way that admits fault for us or binds us, without our written consent.
Term and termination
17.1 Term. The Agreement runs from your acceptance until terminated.
17.2 By you. You may terminate at any time by deleting your Workspace and account. Section 9 governs fees.
17.3 By us. We may terminate for convenience with 30 days’ notice, and then refund prepaid fees for the unused part of any period. We may terminate with immediate effect if you materially breach the Agreement and do not cure it within 15 days of notice, seriously breach the AUP, fail to pay for more than 30 days, or become insolvent.
17.4 Effect. On termination your access and Plans end. For 30 days after termination (except termination for illegal content) you may ask us to export your Sites and content. After that we delete Customer Content as the DPA and Privacy Policy describe, unless the law requires us to keep it. Sections 7.2 (for the retention period), 9 (for unpaid fees), 12, 13, 14, 15, 16, 19 and 20 survive termination.
Changes to these Terms
18.1 We may change these Terms to a reasonable extent, for example because of new or changed features, law, security, our infrastructure or providers, or our business model (Section 1752 of the Civil Code).
18.2 We notify changes by email to Workspace owners and in the Service at least 30 days before they take effect. Changes required by law, or that concern only new features, may take effect sooner.
18.3 You may reject a change by terminating the Agreement with effect before the change applies. If the change is materially adverse to you and you terminate for that reason, we refund prepaid fees for the unused period. If you do not terminate, the change applies from its effective date.
Governing law and disputes
19.1 Czech law. Czech law governs the Agreement, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods.
19.2 Courts. The Czech courts competent for our registered office have exclusive jurisdiction. We may also bring proceedings in the courts of your registered office.
19.3 Talk first. Before going to court, the parties try for 30 days to resolve a dispute by email. This does not prevent urgent interim relief.
Czech-law provisions and general terms
20.1 Type of contract. The Agreement is an innominate contract under Section 1746(2) of the Civil Code, not a contract for work.
20.2 Excluded provisions. Between us as entrepreneurs, the following do not apply: Section 1740(3) (acceptance with amendments); Section 1751(2) (conflicting business terms), so your purchase orders and business terms never apply, even if referred to; Section 1757(2) (confirmation with deviations); and Sections 1799 and 1800 (adhesion contracts), as Section 1801 permits. You assume the risk of a change in circumstances under Section 1765(2), and Section 1766 does not apply.
20.3 Express acceptance. Under Section 1753 of the Civil Code, you expressly accept the provisions listed under “Key terms” at the top of these Terms.
20.4 Assignment. You may not assign the Agreement without our consent. We may assign it to an affiliate or to a successor in a merger, acquisition or sale of assets, and you consent to that assignment in advance under Section 1895 of the Civil Code. We may use subcontractors and remain responsible for them.
20.5 Notices. We send notices to your Workspace owner’s email or in the Service. You send notices to hey@tandmade.com. Email meets any written-form requirement between us. A notice is received on the business day after it is sent.
20.6 Other. If a provision is invalid, the rest remains in force, and the parties replace it with a valid provision closest to its purpose. Not enforcing a right is not a waiver. The parties are independent contractors. The Agreement creates no rights for third parties. It is the entire agreement on its subject and supersedes earlier arrangements. It is written in English; any translation is for convenience only.
